Aventara Travel – Passenger Waiver

1. IMPORTANT LEGAL NOTICE

By completing a booking with Aventara Travel Pty Ltd (“Aventara”), you (“the Participant”) agree to this Passenger Waiver & Release Agreement (“Agreement”).

This Agreement is legally binding.

If you do not agree, you must not proceed with payment or participate in any Aventara trip.

2. NATURE OF AVENTARA SERVICES

Aventara provides travel coordination services only, including:

• Flight and transport booking
• Accommodation booking
• Optional third-party activity coordination
• A peer group Facilitator

Aventara does NOT provide:

• Supervision
• Duty of care
• Professional guiding
• Medical services
• Emergency response
• Behaviour monitoring
• Escort or guardian services

You travel independently and voluntarily at your own risk.

The Aventara Facilitator travels as a peer coordinator only, not as a supervisor, protector, medic, or authority figure.

3. RELEASE OF LIABILITY & WAIVER OF CLAIMS

(To the maximum extent permitted by Australian law)

You release Aventara and all related parties (directors, staff, contractors, agents, representatives) from liability for:

• Injury
• Illness
• Food poisoning
• Drowning
• Accidents
• Death
• Emotional distress
• Property loss or theft
• Missed transport
• Delays or cancellations
• Acts of other participants
• Acts of third-party providers
• Criminal acts of third parties
• Weather or environmental hazards
• Natural disasters
• Pandemics
• Government restrictions
• Consequences of your own behaviour

You agree that this waiver applies to simple negligence to the maximum extent allowed by law.

4. ASSUMPTION OF RISK & PERSONAL RESPONSIBILITY

You acknowledge that:

• International travel involves inherent risks
• You voluntarily participate
• You are fully responsible for your own safety
• You must obey local laws
• You are responsible for your belongings
• You manage your own alcohol consumption
• You manage your own medical conditions
• You are responsible for punctuality
• You accept the consequences of your actions

Aventara is not responsible if you:

• Are injured
• Miss transport
• Lose property
• Are arrested
• Become intoxicated
• Violate laws
• Lose travel documents
• Engage in risky behaviour

5. AVENTARA FACILITATOR – LIMITED ROLE

The Facilitator:

• Is not a tour guide
• Is not a supervisor
• Is not medically trained
• Is not responsible for your conduct
• Is not required to accompany you
• Is not responsible for lost property
• Does not supervise nightlife or intoxication

Their role is limited to:

• Meeting points
• Basic coordination
• Optional activity coordination

They owed no personal duty of care to you.

6. THIRD-PARTY OPERATOR ACTIVITIES

All activities are operated by independent third-party providers.

You acknowledge that:

• Aventara does not control these operators
• Aventara is not responsible for their acts or omissions
• You participate at your own risk
• You agree to third-party waivers and conditions

You release Aventara from all claims arising from:

• Third-party negligence
• Contract disputes
• Misrepresentation
• Cancellation

7. INDEPENDENT FREE TIME

During free time:

• You choose your own activities
• You assume all risks
• You make independent decisions

Aventara has no responsibility for your actions during free time.

8. ALCOHOL, DRUGS & MISCONDUCT

Aventara is not responsible for incidents involving:

• Alcohol consumption
• Drug use
• Altercations
• Illegal acts

If your behaviour endangers others or damages property:

• You may be removed without refund
• You remain fully financially liable
• Aventara bears no responsibility

9. MANDATORY TRAVEL INSURANCE

You must hold comprehensive travel insurance covering:

• Medical
• Hospital
• Evacuation
• Repatriation
• Cancellation
• Lost baggage
• Activities

Aventara bears no responsibility for uninsured losses.

10. MEDIA CONSENT

You grant Aventara unrestricted permission to use:

• Photos
• Videos
• Group content

For marketing purposes without compensation.

11. INDEMNITY

You agree to fully indemnify Aventara for:

• Claims caused by your actions
• Damage you cause
• Legal costs resulting from your conduct

12. GOVERNING LAW & JURISDICTION

This Agreement is governed exclusively by Queensland law.

Any legal action must be brought in Queensland courts only.

You agree to pay Aventara’s legal costs if your claim is unsuccessful to the extent permitted by law.

13. ACCEPTANCE

By ticking “I Agree” you confirm that:

• You understand this Agreement
• You accept all risks
• You voluntarily release Aventara
• You agree to be legally bound
