AVENTARA TRAVEL – PASSENGER WAIVER & RELEASE AGREEMENT

1. IMPORTANT LEGAL NOTICE
By completing a booking with Aventara Travel Pty Ltd (“Aventara”), you (“the Participant”) agree to this Passenger Waiver & Release Agreement (“Agreement”). This Agreement is legally binding. If you do not agree to these terms, you must not proceed with payment or participate in any Aventara trip.
2. NATURE OF AVENTARA SERVICES
Aventara provides travel coordination services only, which may include:
- Flight and transport booking
- Accommodation booking
- Optional third-party activity coordination
- A peer group facilitator for logistical coordination
Aventara does not:
- Provide supervision or guardianship
- Provide medical care or health advice
- Provide emergency response services
- Provide professional guiding or instruction
- Monitor participant behaviour or nightlife
- Assume responsibility for personal safety decisions
Participants travel voluntarily and independently, at their own risk. The Aventara facilitator acts solely as a group coordinator and does not act as a supervisor, protector, medic, or authority figure.
3. RELEASE OF LIABILITY & WAIVER OF CLAIMS
To the maximum extent permitted by Australian law, you release Aventara and all related parties (including directors, staff, contractors, agents, and representatives) from liability for loss, damage, injury, illness, delay, disruption, or expense arising from:
- Accidents or incidents
- Illness, injury, or death
- Food poisoning or allergic reactions
- Drowning or water-based activities
- Emotional distress
- Property loss or theft
- Missed transport or delays
- Acts or omissions of other participants
- Acts or omissions of third-party providers
- Criminal acts of third parties
- Weather or environmental conditions
- Natural disasters or pandemics
- Government actions or restrictions
- The consequences of your own actions or decisions
Nothing in this Agreement excludes, restricts, or modifies any rights or remedies available under Australian Consumer Law.

4. ASSUMPTION OF RISK & PERSONAL RESPONSIBILITY
You acknowledge and agree that:
- International travel involves inherent risks
- You participate voluntarily
- You are responsible for your own safety and wellbeing
- You must comply with local laws and regulations
- You are responsible for your belongings
- You manage your own alcohol consumption
- You manage your own medical conditions
- You are responsible for punctuality and attendance
- You accept the consequences of your personal decisions
Aventara is not responsible if you:
- Are injured or become unwell
- Miss transport or connections
- Lose personal property
- Are detained or arrested
- Become intoxicated
- Violate laws
- Lose travel documents
- Engage in risky or unlawful behaviour
5. AVENTARA FACILITATOR – LIMITED ROLE
The facilitator:
- Is not a tour guide
- Is not a supervisor
- Is not medically trained
- Does not provide personal safety management
- Is not required to accompany participants at all times
- Does not supervise nightlife or intoxication
The facilitator’s role is limited to:
- Meeting points
- Basic group coordination
- Optional activity coordination
The facilitator does not assume a supervisory, protective, or custodial role.
6. THIRD-PARTY OPERATOR ACTIVITIES
All activities are operated by independent third-party providers. You acknowledge that:
- Aventara does not control third-party providers
- Aventara is not responsible for their acts or omissions
- Participation in third-party activities is at your own risk
- You are bound by third-party terms, conditions, and waivers
7. INDEPENDENT FREE TIME
During free time:
- You choose your own activities
- You assume all risks
- You make independent decisions
- Aventara has no responsibility for actions taken during free time.
8. ALCOHOL, DRUGS & MISCONDUCT
Aventara is not responsible for incidents involving:
- Alcohol consumption
- Drug use
- Altercations
- Illegal acts
If your behaviour creates risk or disrupts the group:
- You may be removed without refund
- You remain financially responsible for resulting costs
- Aventara bears no responsibility
9. MANDATORY TRAVEL INSURANCE
You must hold comprehensive travel insurance covering, at minimum:
- Medical and hospital expenses
- Evacuation and repatriation
- Cancellation and interruption
- Lost baggage
- Activities undertaken
Aventara is not responsible for uninsured losses.
10. MEDIA CONSENT
You grant Aventara permission to use photos, videos, and group content captured during trips for marketing and promotional purposes, without compensation.
11. INDEMNITY
You agree to indemnify Aventara for any loss, damage, or legal costs arising from your actions, conduct, or breach of these terms, to the extent permitted by law.
12. GOVERNING LAW & JURISDICTION
This Agreement is governed by the laws of Queensland, Australia. Any legal proceedings must be brought exclusively in Queensland courts.
13. ACCEPTANCE
By ticking “I Agree”, you confirm that:
- You have read and understood this Agreement
- You accept the risks involved
- You voluntarily agree to be bound by these terms
